Terms & Conditions
By engaging College Storage Services (“CSS”) in the movement, transportation and/or storage of items including, but not limited to, boxes and packages within the United States or internationally, and jointly through interchange with its partner companies, you (the “Customer”) agree to be bound by the terms and conditions contained in the following paragraphs (this “Agreement”). In addition, terms for the shipment of goods via our preferred shipper, FedEx®, can be found at: reserves all rights not expressly granted in this Agreement. If at any time you do not agree to be bound by the following terms, please immediately discontinue usage of CSS’ services and notify CSS immediately in writing.
OWNERSHIP OF PROPERTY:
The Customer represents and warrants that he or she is the legal owner, or in lawful possession, of any property for which the Customer has engaged CSS to transport or store, that he or she has the legal right and authority to contract for services of all of the property tendered, upon the provisions, limitations, terms and conditions set forth in this Agreement, and that there are no existing liens, mortgages or encumbrances on said property. CSS shall have a lien on any property tendered to it for all charges, fees, costs, or other recompense that may be due to it for services rendered.
Storage Services shall include the pickup, transportation, storage, and delivery of the Customer’s packages. The Customer shall present pre-packed personal goods to CSS or its representative partner at the pre-arranged time of pickup. CSS or its representative partner shall transport these goods to a climate-controlled storage facility chosen at the sole discretion of CSS. CSS will return the goods to the Customer during dates and times established by CSS in consideration of school and dormitory academic calendars’. The Customer agrees to be present to receive the goods at a specified delivery date, time and location or pick up from an on-campus mail room or designated shipping receiver.At its discretion CSS may require a non-refundable deposit fee in the amount of $25 to reserve a storage space. Payment in full is required at the time the Customer registers for services. The Customer agrees to pay in full within 30 days of billing date for additional service charges incurred. Unpaid balances that exceed 30 days will be charged a $35 late fee, and incur interest at the maximum legal rate. The Customer understands access to goods in storage is permitted only with 7 business days’ prior notice and upon payment of a $75 non-refundable fee. If the items must be delivered prior to the specified delivery date and time, an additional $125 fee will apply. The Customer has the option to purchase access coverage in the amount of $45 for up to one visit to the storage facility. Purchase for access coverage must be made at the time the Customer pays for CSS services.Additional visits by the Customer will require a payment of $60 per visit.Changes to the previously scheduled delivery date or location must be communicated by the Customer in writing to CSS at least 10 business days prior to the earlier of the originally scheduled delivery date and the new delivery date. Changes made within 10 business days of delivery are not guaranteed. An additional $50 fee may be assessed. CSS provides insurance for items in storage, subject to a $100 limit per box or un-boxed item. The Customer shall not store items with CSS that have a value greater than $100. Additional insurance is available to the Customer at www.studentinsurance.com. CSS reserves the right to refuse any service to anyone at any time.
SHORT-TERM SUMMER STORAGE:
Short-term storage is for 1 - 35 consecutive days. Delivery date for short-term storage will take place on the next business day and exclude major holidays or weekends. Hours of delivery are 9 a.m. – 5 p.m., Monday – Friday. If a weekend or holiday delivery is required, the Customer agrees to pay a delivery fee of $250. If early delivery of items is required by Customer, Customer agrees to pay for storage plan minimums and shall not receive a refund, proration for unused day(s) or any other credit or compensation. Customer shall select a delivery window time of 1.5 hours during delivery hours and be present or designate someone to be present to receive delivery. Customer agrees to pay $10 per box, per day for items that are stored longer than allotted plan time. Early delivery and weekend delivery fees will apply as stated in the preceding paragraphs. Customer agrees to store a minimum of 4 boxes at the rates of $40 per box.Off-campus delivery will be available for locations within a 4-mile radius of campus. Delivery locations outside of 4-mile radius will result in a $125 fee.
CSS shall act only as an intermediary for the receipt and forwarding of the Customer’s items to CSS’ preferred shipping carrier (FedEx®). The Customer agrees to complete a Shipping Order (SO) provided by CSS in a legible and complete manner prior to pickup of the goods by CSS. CSS will pick up and transport the shipping items to FedEx. FedEx will deliver the items to the address specified on the shipping labels after processing their pickup. FedEx will be used for all shipments. FedEx Ground or Home Delivery is the preferred level of service that will be used unless the Customer specifically requests and pays for an express service or international service. At its sole discretion, CSS may choose to accept or reject the Customer’s items being shipped. CSS is not responsible for any loss or damage to the Customer’s items caused during transport by FedEx. It is the Customer’s responsibility to file a claim with FedEx for damaged or lost items. Customer agrees to retain damaged items and all packing materials until claim is paid by carrier. The Customer agrees to familiarize himself or herself with FedEx restrictionsand claim process, found at www.fedex.com, and not to ship items that are designated unacceptable by FedEx. Shipments delayed or held by FedEx due to use of packaging may result in additional fees as designated by the carrier. The Customer agrees to pay any additional fees imposed by FedEx. CSS may provide the Customer a shipping estimate but final rate is determined by FedEx and then charged to the Customer. Customer agrees to pay any shipping rate difference as provided by the carrier. At its discretion, CSS may file and process a claim on the Customer’s behalf for delayed shipping deliveries, if applicable, or damaged or lost packages. This applies only to domestic shipments within the continental United States. The Customer further agrees they will maintain a copy of their tracking number provided by the shipper and all documentation related to the shipment. Tracking numbers are not the responsibility of CSS and may be provided to Customer at the time of shipping. Customer further agrees to provide necessary documents as requested by CSS to file any and all claims on the customers’ behalf.
CSS must receive shipped items per a set date as agreed with select campus prior to the scheduled campus move-in date for items that are shipped from the Customer’s home to the Customer’s school. Any items that are not received by agreed set date between select campus and CSS may be subject to additional charges and delivery date is not guaranteed by CSS. It is the Customer’s responsibility to ensure that items are shipped to meet this set date deadline.
The Customer shall be solely responsible for taxes, tariffs, duties or any other fees due to destination or receiving country. The Customer accepts and agrees to pay for any and all fees or payments to a destination country government, private agency or agent. CSS will act as the intermediary and collect such payments from Customer to clear shipped items for release, but CSS shall not be responsible for failing to anticipate incurred fees or costs. The Customer agrees to prepare all international shipping forms accurately and truthfully. International shipments inbound to a U.S. campus must be picked up at Customer’s home by carrier no later than 15 business days prior to move-in or arrival date. CSS is not responsible for delayed deliveries to campus due to customs or any other agency, public or private. International shipments bound for other countries must not contain items deemed unacceptable by the destination country or carrier. The Customer accepts ultimate responsibility for all items being shipped and agrees to indemnify and hold CSS harmless for any items denied entry by a destination country, or for any liabilities associated therewith. The Customer agrees to pay CSS a rate of $15 per day for any items held in storage due to being denied for shipment and/or returned to CSS. IT IS THE CUSTOMER’S SOLE RESPONSIBILITY TO DETERMINE IF ITEMS CAN BE SHIPPED TO THE DESTINATION COUNTRY. The Customer agrees to confirm the acceptability of their shipment with FedEx and any destination country or countries prior to contacting CSS for shipping arrangements. All shipping charges, fees, costs, duties, tariffs or other amounts to be incurred in shipment must be paid to CSS in full prior to item(s) being shipped. If required CSS may make the determination for the Customer at an additional of $25.
Retail-to-School delivery will be offered on a limited basis to select campuses. Purchases made by Customer and shipped to CSS must be insured for the retail value at the time of shipment. Customer agrees to be responsible for processing any claim with carrier for any damage or loss during shipping. Customer agrees to add campus name to Customer name when shipping purchased items to CSS.Example: Jane Doe/XYZ UniversityThe Customer agrees to indemnify and hold harmless CSS, its affiliates, contractors, employees, management or any other representative for any items lost or damaged during shipping. CSS will deliver purchased item(s) to campus on regular move-in day according to campus academic calendar for move-in or to students room prior to move-in. Customer agrees to contact and notify CSS of retail purchase shipments prior to shipping. Customer further agrees CSS is not responsible for items shipped prior to CSS agreement or authorization to receive shipped purchased items. Any items not shipped by the set date as agreed by CSS and the select campus will be subject to an additional $75 delivery fee. It is the Customer’s responsibility to ensure items are shipped by set date.
PICKUP & DELIVERY:
CSS establishes pickup and delivery dates and times based on campuses academic calendar. The schedule will be communicated directly to the Customer at time of signup. CSS reserves the right to reschedule such times in its sole discretion, without prior notice to the Customer. In the event that the Customer is unable to be present during the pickup window or if the pickup location changes, the Customer must provide notice to CSS 5 business days prior to the scheduled pickup date. Failure to provide timely notice will result in a charge to Customer of CSS’ prevailing fee of $50 for pickups outside of the scheduled pickup date.In the event that the Customer is not present during the scheduled delivery date and time, CSS’ designated representatives or carrier will leave the Customer’s belongings inside or outside their room or at a designated mailroom or receiving location, as available, and any obligations or liability of CSS for the Customer’s belongings will immediately cease. The Customer expressly recognizes that CSS will not be liable for any damage to their belongings or loss after delivery, whether the Customer is present or not. If the Customer is absent during delivery, the signature of CSS’ designated representative making the delivery will evidence the delivery of the Customer’s items in good condition. A rescheduled or missed pickup will result in an additional $65 fee.The Customer recognizes that only loss or damage caused by the negligence of CSS will be covered by the CSS declared value policy, as described in these Terms and Conditions. Only physical damage to the exterior of the item will activate any insurance claim on the item.If a Customer’s items are improperly packed and the Customer would still like to store or ship those items, CSS will pack or re-pack the Customer’s items, and Customer shall pay an additional fee at CSS’ prevailing hourly service rate ($35) with a one-hour minimum. This fee will not include any packing materials used. Packing materials will be charged separately, according to CSS’ prevailing packing material fees, as such additional fees are set forth on the CSS Website.Additional fees and charges will be assessed if the Customer does not live on-campus. CSS will assess such fees and charges based on the distance from the main campus and the time it takes to travel to such location, according to CSS’ prevailing standard rates for delivery and travel. In any event and in addition to any other applicable fees and charges, a minimum fee of $125 will be charged for any pickup or drop-off that is not on the school’s main campus plus a $35 dedicated pick up fee. Any delivery outside of normal scheduled delivery to campus will result in a $250 delivery fee plus a $35 dedicated delivery fee. Pick up and/or delivery changes or notices less than 10 business days in advance will result in a $125 fee. Customer agrees to pay CSS $35 for each box over 40 lbs and/or over 4 cubic feet in over all dimension. Failure to pay such fees may result in stored items being considered abandon. Abandon items will be disposed of as CSS sees fit and Customer agrees to pay for any and all costs associated with disposal.
CSS SERVICE GUARANTEE:
With regard to the items processed by CSS for shipping services, CSS assumes no liability for the failure to make any specified delivery time or for the successful completion of delivery of the items or the contents thereof. CSS guarantees on-schedule pickup of shipping and storage items and delivery of storage items. CSS will provide the Customer with a maximum window of four (4) hours during which pickup or delivery will occur. In the event CSS fails to arrive to pick up or deliver the Customer’s goods during the specified time window, CSS will issue a credit equal to 10% of the total price of the Customer’s order (excluding taxes), subject to the conditions below:The Customer was present in their residence throughout the applicable four-hour window.In the case of pickup, the customer has all packages packed, labeled, and prepared for pick up prior to CSS arrival.In the case of the delivery of stored goods, the Customer has correctly labeled each of their packages with their name.CSS is notified in writing or by telephone of a service failure within seven (7) calendar days from the date of the scheduled pickup or delivery.This guarantee does not apply if the failure to perform within the pickup or delivery window is due to causes beyond CSS’ control including, but not limited to, the following: the unavailability or refusal of a person to accept delivery of the stored items; acts of nature; public authorities acting with actual or apparent authority on the premises; acts or omissions of police or similar authorities; riots, strikes, or other labor disputes; civil commotions; disruptions in ground transportation networks, such as weather phenomena; and natural disasters.
COMMODITIES HANDLED & RESTRICTIONS:
Since CSS will act as an intermediary for our Shipping Carrier, the Customer must be advised that our Carrier holds itself out to transport general commodities, as usually defined, subject to the restrictions that are available at their Website. The Customer agrees to familiarize themselves with the Carrier’s restrictions and claims process, located at www.fedex.com, prior to packing and shipping their articles.CSS provides storage services subject to a number of restrictions. The Customer accepts full responsibility and liability for any damages or losses that result from the Customer’s failure to adhere to these service restrictions. No storage service shall be rendered:In the case of articles of unusual value, or of single packages having a value of more than $100 (U.S), or of collective packages having a value of more than $1000 (U.S.).For items containing valuables such as jewelry, collectibles and currency.For hazardous materials and firearms.For any items that are prohibited by law or regulations of any federal, state, provincial, or local government in the U.S.For the transportation and storage of articles prohibited by CSS’ logistics vendors.CSS will not store or ship packages containing food or liquids, and the Customer acknowledges that they are liable for any damage their storage contents may inflict on the property of others.CSS reserves the right to refuse any package which by reason of the dangerous or other character of its contents is liable, in the judgment of CSS, to soil, taint, or otherwise damage other merchandise or equipment, or which is economically or operationally impractical to transport, or which is improperly packed or wrapped. CSS reserves the right to open and inspect any package tendered to it for storage or shipping.
CSS automatically protects each CSS storage and shipping package against loss or damage up to a value of $100. The Customer agrees that the released value of each package is no greater than $100 and that CSS liability is limited to $100. The Customer hereby agrees to assume all risk of loss, including damage or loss by burglary, fire, vandalism or vermin, acts of nature or terrorism. CSS and CSS’ agents, affiliates, authorized representatives and employees will not be responsible for, and the Customer hereby releases from, any loss, liability, claim, expense, damage to property or injury to persons that could have been insured (including without limitation any loss arising from the active or passive acts, omission or negligence of CSS or its agents, affiliates, authorized representatives and employees).Where the replacement value of the Customer’s possessions exceeds $100 per package CSS recommends the purchase of additional insurance. Additional insurance is available at www.collegestudentinsurance.com and must be purchased by Customer.The Customer releases CSS of any liability for damage to items within a carton, trunk or other casing without physical damage to the exterior. The Customer is liable for any damage their stored items may inflict on the property of others. All coverage is limited to the dates when CSS has possession of the Customer’s items. A surcharge will be applied to Customer’s bill for items not shipped in a box.
Without limiting the right of CSS to conclude for other reasons that the Customer will not be returning to school, the Customer agrees that their failure to be present on the scheduled delivery day and their failure to communicate with CSS concerning an alternate delivery arrangement constitutes abandonment of their stored possessions.Under abandonment of their possessions, the Customer agrees to pay CSS for all charges and fees relating to the failed delivery, $65, and further shipping of the possessions to the permanent address provided by the Customer at the time of registration. If not claimed or delivered within 60 days of the first day classes begin, CSS has the right to assume ownership of the abandoned property on December 30th of the service year. This policy excludes CSS Website-registered study-abroad program students.
PACKING MATERIALS DELIVERY:
At its discretion CSS will make available packing materials one week prior to the move-out week. CSS will notify the Customer in advance of the dates, times and locations where materials can be picked up. It is the Customer’s responsibility to make arrangements to acquire packing materials during the dates, times and locations specified.Less than 14-day and less than 30-day storage delivery will take place no later than 3 days prior to scheduled move-out date. Storage boxes used by the customer that are not CSS storage boxes will be charged at a separate rate based on CSS box. The rate will be based on the nonconforming box largest dimension or cubic feet, whichever is greater. Boxes weighing over 40 lbs. and/or more than 4 cubic feet will be charged a $65 surcharge at the sole discretion of CSS.
YOU HAVE FULL RESPONSIBILITY FOR, AND BEAR ALL RISK OF LOSS OR DAMAGE TO THE BOXES AND THEIR CONTENTS, AND FOR ANY DAMAGE CAUSED TO YOUR PROPERTY OR TO THE PROPERTY OF OTHERS BY THE BOXES OR BY THEIR CONTENTS WHILE THE BOXES REMAIN IN YOUR POSSESSION, INCLUDING WHILE THE BOXES ARE ON YOUR DRIVEWAY OR LOADING DOCK, OR IN ANY HALLWAY OR ANY OTHER COMMON AREA OF YOUR RESIDENCE. SUBJECT TO THE SECTION ENTITLED INSURANCE, FOLLOWING PICKUP OF YOUR BOXES FROM YOUR RESIDENCE UNTIL THE BOXES ARE DELIVERED TO YOU, CSS DOES NOT ASSUME ANY RISK FOR LOSS OR DAMAGE TO THE PERSONAL PROPERTY YOU HAVE PLACED IN THE BOXES FOR STORAGE, NO MATTER HOW THE LOSS OR DAMAGE MAY BE CAUSED, EXCEPT FOR LOSS OR DAMAGE CAUSED DIRECTLY BY OUR GROSS NEGLIGENCE OR WILLFUL MISCONDUCT, AND IN ANY EVENT CSS’ AGGREGATE MAXIMUM LIABILITY TO YOU SHALL NOT EXCEED THE FEES YOU PAID FOR THE SERVICES. Customer shall defend, indemnify and hold harmless CSS and its employees, agents and representatives from and against any and all claims, actions, demands, liabilities, damages, costs and expenses.
Customer agrees to provide a credit card at the time services are ordered onine, at pickup or prior to pickup. The Customer agrees to pay the total cost of the services provided by CSS as indicated on the Online Order Form, hard copy Signup Order Form and Customer Agreement, plus applicable taxes, in accordance with the payment terms set forth on the Order Form and Customer Agreement. The Customer further agrees to pay any applicable fees and charges as specified in this Agreement or on the CSS Website, which fees and charges are subject to change at any time. Customer acknowledges that there shall be no refunds or credits provided to Customer, except as expressly set forth in this Agreement.Customer must pay the total cost of the services prior to or at the time of pickup.If the Customer pays by credit card, the Customer hereby authorizes CSS to charge Customer’s credit card within two (2) weeks of the pickup date. In the event that a Customer’s payment cannot be authorized, all charges associated with this Agreement must be paid in full in order to receive your items before the time of their delivery, plus any applicable late fees or other applicable fees and charges. Denied credit cards will be subject to a $25 fee. If the Customer fails to pay any amount within thirty (30) days after it is due, the Customer’s possessions shall be deemed abandoned, and CSS shall have the right, but not the obligation, to take any reasonable action to dispose of any abandoned property, to recover any outstanding balance from the Customer. Customer shall be responsible for any costs incurred by CSS in connection with disposal of Customer’s property. CSS will have no obligation whatsoever to disclose information concerning action taken if any, and may still take necessary legal measures to obtain payment for services provided from the Customer. CSS shall have no obligation to return any proceeds from the disposal of the Customer’s property, and any proceeds in excess of the outstanding balance owed to CSS under this Agreement shall be retained by CSS as liquidated damages.
Like many site operators, CSS collect information that Customers browser sends whenever you visit our Site ("Log Data"). This Log Data may include information such as your computer's Internet Protocol ("IP") address, browser type, browser version, the pages of our Site that you visit, the time and date of your visit, the time spent on those pages and other statistics.
Cookies are files with small amount of data, which may include an anonymous unique identifier. Cookies are sent to Customer browser from a web site and stored on your computer's hard drive.
Like many sites, we use "cookies" to collect information. You can instruct your browser to refuse all cookies or to indicate when a cookie is being sent. However, if you do not accept cookies, you may not be able to use some portions of our Site.
The security of Customer Personal Information is important to CSS, however there no method of transmission over the Internet, or method of electronic storage, is 100% secure. While we strive to use commercially acceptable means to protect your Personal Information, we cannot guarantee its absolute security.
CSS website may contain links to other sites that are not operated by CSS. If Customer clicks on third party links, Customer will be directed to that third party's site. CSS has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party sites or service
This Agreement shall be governed by the laws of the State of California, without regards for conflicts of law. The Customer agrees that any dispute arising out of their usage of CSS’ products and services shall be subject to arbitration before AAA or any other recognized arbitration agency. The Customer expressly waives any right to a jury or court trial, and warrants that he or she shall not participate in any class or representative action with regard to CSS’ services.
